former Minister of Aviation, Stella Oduah Loses Bid To Stop Bulletproof Cars Probe

A Federal High Court in Lagos has dismissed a fundamental rights enforcement suit filed by a former Minister of Aviation, Stella Oduah, against the Attorney General of the Federation and three others.

Justice Okon Abang, who dismissed Oduah’s suit for want of jurisdiction today, ordered her to pay a cost of N15,000 to the AGF.
Oduah had filed the suit in August last year praying the court to restrain agencies of the Federal Government from questioning or prosecuting her over the purchase of two armoured BMW vehicles at a cost of N255m by the Nigerian Civil Aviation Authority under her watch as the Aviation Minister in 2013.

In her suit, Oduah claimed to have already been probed and exonerated by the House of Representatives Committee on Aviation and the Economic and Financial Crimes Commission and urged Justice Abang to declare that any further probe would amount to violating her fundamental rights.

The respondents in the suit were the AGF, the EFCC, the Independent Corrupt Practices and other related offences Commission and the Inspector General of Police.
Oduah alleged that the ruling All Progressives Congress intended to use the respondents to persecute her, being a prominent member of the opposition Peoples Democratic Party.

She claimed that the Federal Government had perfected plans to try prominent members of the PDP on trump up charges in a special Lagos State High Court, so as to turn the country into a one-party state.
She begged the court to restrain the respondents from unleashing repression against her.
But the EFCC denied doing the bidding of the APC, claiming that it was independent.
It furnished the court with a petition dated October 18, 2013 written by a lawyer from the chambers of Mr. Femi Falana (SAN), calling for Oduah’s investigation.

The EFCC disclosed that the said petition was captioned, ‘Request for Investigation of Economic and Financial Crimes of the sum of N255m by Aviation Minister, Ms. Stella Oduah’.
The EFCC urged the court to dismiss Oduah’s suit.
But in his judgment, Justice Abang dismissed the EFCC’s objection for not complying with Order 8 Rule 1 of the Fundamental Rights Enforcement Procedure.
“The EFCC did not file any opposition in line with the law,” Justice Abang held.
The judge, however, upheld the preliminary objection filed by the AGF, who challenged the jurisdiction of the Federal High Court in Lagos to entertain Oduah’s suit.
Counsel for the AGF, T.A. Gazali, had contended that since the rights violation that Oduah alleged did not happen in Lagos, it would be a violation of Section 46(1) of the constitution and Order 2 Rule 1 of the Fundamental Rights Enforcement Procedure to entertain the case in Lagos.

“From the whole of the applicant’s averments, there is nowhere she mentioned that her right was or is being breached by the respondents within the territorial space called Lagos.
“There is nothing to show that the applicant was invited, arrested or detained in Lagos by any of the respondents in the suit.
“The Federal High Court sitting in Lagos cannot assume jurisdiction to entertain alleged breach of fundamental rights that did not take place in Lagos State,” Gazali had argued.
Justice Abang upheld Gazali’s argument and dismissed Oduah’s case.
The judge also held that if the Federal Government had any valid reason to arraign Oduah in a Lagos State High Court as she alleged, it would not amount a violation of her right.
Meanwhile, in another judgment, Justice Abang also refused a prayer to stop the EFCC and the Department of State Services from arresting and probing a former Special Adviser to ex-President Goodluck Jonathan on Niger Delta Affairs and the Chairman of the Presidential Amnesty Programme, Kingsley Kuku.
The judge dismissed Kuku’s suit for lacking in merit, but restrained the respondents from detaining him beyond 48 in contravention of Section 35(4)(5) of the Constitution.

Dokpesi re-arraigns by EFCC over alleged N2.1bn fraud

The Economic and Financial Crimes Commission EFCC today re-arraigned former chairman of DAAR communications Plc, Raymond Dokpesi before Justice John Tsoho of the federal high court, Abuja, over a six-count charge of criminal breach of public procurement law to the tune of N2.1bn, the same charges filed against him in December.

During the hearing, Dokpesi pleaded not guilty to all charges. His counsel, Wole Olanipekun, Dokpesi’s lawyer, asked the presiding judge to allow him maintain the bail he was granted by Justice Kolawole on December 14. He said his client had been of good behaviour since the bail was granted.

After listening to the counsel, the judge ruled that the bail granted Dokpesi be maintained. He adjourned the case to March 2 and 3 for commencement of trial.

Lagos-- Pipeline vandals kill two naval officers

Two naval officers and a boat operator were killed in a recent face-off between the joint security forces and pipeline vandals around Ishawo/Arepo area of Ikorodu, Lagos state governor, Akinwunmi Ambode has been told.

Men of the Nigerian Army told Ambode yesterday that the incident occurred during Operation Awatshe where 15 suspected vandals were arrested and over 2,000 50-litre jerry cans seized and 36 vehicles impounded.

Meanwhile in Ibadan, Oyo State, three men were on Tuesday granted bail by the Federal High Court after being charged for alleged vandalism of pipelines.

Ambode who said that the state would no longer condone vandalism directed the Nigerian Army, Police and other security personnel to immediately intensify arrest of suspected vandals and cultists in the state.

Commanding Officer of 174 Battalion Lieutenant Colonel Julius Ogbebo had told Ambode during an inspection tour of Ishawo/Arepo on Tuesday, that the joint forces had recovered Little Palace Hotel, one of the locatons the vandals often used to commit their criminal activities in the area.

Ogbedo said: “Also sir, we have recovered over 36 vehicles and we have more than 15 suspects. Some of them have been handed over to the Nigeria Security and Civil Defence Corps (NSCDC) for prosecution and further action.

So far, we have tried to garrison Ishawo and Arepo but still the vandals have not relented in their activities.

Last week, we lost two of our Naval personnel and a boat operator,” he said.

The governor, who commended the security forces, said that it was high time the government had deployed all of its might to clampdown on the vandals and other criminals.

He said: “I would like to use this platform to give a very strong warning to vandals and even cultists that are parading themselves on the streets of Lagos. Just recently, we heard that the fingers of some of our men in the Task Force were chopped off by some hoodlums.

“I am using this platform to direct our security forces that they should go ahead to use appropriate force to mitigate such incidents in the overall interest of all of us while we we are upholding the rule of law,” he said.

Commending Operation Awatshe since their deployment to the axis last year, Ambode said: “I have come here personally with heads of security agencies and the security council members in Lagos state to first appreciate the work of security agencies that have been posted here since last October and to also commend you for the improvement we have made since the time that you commenced operation here.”

Mad man caught with 22 ATM cards

The operatives of the Rapid Response Squad (RRS) of the Lagos State Police Command have arrested a mad man in possession of 22 ATM credit cards, 2 mobile phones and power bank in Victoria Island area of Lagos, Southwest Nigeria.

The man, Lanrewaju Jaiyeola, 39, was intercepted by the operatives where he was sighted in a suspicious manner carrying a backpack on Ozumba Nbadiwe Road.

According to one of the Police officers who arrested Jaiyeola, “when we sighted him, he appeared like a mentally sick man but we invited him for interrogation, he answered and responded normal to all our enquiries.

“Afterwards, he started straying from the normal course of our enquiries. This raised further curiosity and we decided to check out his backpack. What we found was startling; 22 assorted credit cards, 1 Nokia phone with flat battery, a blackberry, a power bank, several bank tellers of recent bank transactions, and lots of invoices amidst numerous pieces of papers.

“On further scrutiny, we discovered that eight of the credit cards were still valid. Out of these; three would expire in 2018, another three would expire in 2017 while two would expire in 2016. All the credit cards bore different names and banks”, the officer stated.

Upon arrival at the RRS Headquarters in Alausa, the suspect made “statements suggestive of somebody disguising as a mad man to perpetrate crime around that axis.

“Initially, we noticed that he was mentally balanced because he was answering the questions posted to him adequately. But all of a sudden, he started to sound incoherent and illogical again”, the officer explained.

The Police authority said that there is still more to what they have discovered from the supposedly mad man.

While interrogating him, he threatened the investigative Police officer, saying “I will make life unbearable for you if you don’t let me go. It was at this point we realised that possibly he might be enjoying the patronage of some highly placed people whom we believe he might working for”, the officer added.

It was further learnt that the suspect was on the watch of the Police for about two weeks before he was arrested on Wednesday.

The suspect has been transferred to Special Anti-Robbery Squad where he is expected to be subjected to further investigations and psychiatric examinations.

The Economic and Financial Crimes Commission, EFCC, on Tuesday arraigned a senior lawyer, Rickey Tarfa, before Justice Aishat Opesanwo of Lagos State High Court, Igbosere, on 2-count charge of obstruction of justice and attempting to pervert the course of justice.
Mr. Tarfa pleaded not guilty to both counts.
Based on his plea, the prosecution counsel, Rotimi Oyedepo prayed the court for a trial date and to remand the defendant in custody.
However, Adeniyi Akintola, a Senior Advocate of Nigeria, SAN, who led a team of over 90 Senior Advocates and other lawyers to represent Mr. Tarfa, said they had filed an application for bail which he said was served on the prosecution on the 10th of February, 2016.
In his application for bail, the defence counsel told the court that the defendant went to court voluntarily and that he was granted administrative bail by EFCC on self-recognition.
He said the defendant was a very senior member of the bar with no criminal record. He said there was nothing to show that the defendant would jump bail.
However, prosecution counsel, Rotimi Oyedepo, urged the court to dismiss the application as the offence was grave. He urged the court to dismiss the application and order for an accelerated hearing.

Justice Opesanwo, in her ruling, granted bail to Mr. Tarfa on self-recognition but ordered that he must not travel out of the country without the permission of the court.
The trial judge bemoaned the number of counsel who were in court for the defendant. She noted that there was no need for such magnitude of support as it amounts to harassment and intimidation of the court.
Soon after the ruling, Mr. Akintola told the court that he had filed an application to quash the charge.
Mr. Rotimi responded that he had not been served. He was subsequently served by the defence counsel in open court.
Justice Opesanwo adjourned the matter to March 14, for hearing of the application to quash the charge while the substantive case was fixed for April 20, 2016 for trial.
Mr. Ricky Tarfa, SAN, is accused of willfully obstructing two officers of the EFCC, Moses Awolusi and Sanusi Mohammed from arresting Gnanhooue Sourou and Nazaire Odeste, who were suspected to have committed economic and financial crimes in contravention of Section 38(2) (a) of the EFCC Establishment Act of 2004.

$2.1bnArmsDeal: Ex-Airforce Chief Returns N66Million

Abuja One of the Nigerian Air Force (NAF) chiefs implicated in the $2.1 billion arms deal and put under house arrest at Niger Barracks, Abuja has returned N66 million of the N90 million, allegedly traced to him, to the Economic and Financial Crimes Commission (EFCC). Consequently, the officer, a Principal Staff Officer at NAF Headquarters, was released from detention and asked to go and look for the balance of the money. An EFCC source, however, said this did not mean he is completely exonerated.

Sunday Vanguard gathered that the other officers being detained by the NAF High Command, on behalf of the EFCC, were not allowed the privileged because they had refused to cooperate fully with the EFCC interrogation team even though some had returned exotic cars and other valuables.

It was also gathered that an Air Commodore, said to have benefitted from the arms deal and has properties in Dubai, Kaduna and Abuja, has been arrested and is in detention. One of the detained Air Vice Marshals (AVMs) is said to be the leader of the team that went to buy aircraft with incomplete parts and also inflated the price from $6million to over $30million. NAF High Command had, on Thursday, stepped up its anti-corruption war with the removal of some officers including Air Officers Commanding and Principal Staff officers manipulated in the arms deal and appointed new Air Officers Commanding.

Meanwhile, the wife of a former Chief of the Air Staff, Mrs. Lara Amosu, detained overnight by the EFCC, has been freed. Sunday Vanguard gathered that the wife was detained following certain accounts related to her husband, being investigated in connection with the $2.1 billion arms cash, allegedly traced to her. Although the exact figure and details of the accounts were not made public, EFCC was said to have interrogated her for hours last week in Lagos. But a source close to the investigation confirmed the woman had been released on bail.

“She is not in our custody having been granted administrative bail. She will be asked to report back whenever we need her for further investigation,” the source said. The source said the money allegedly recovered from the former air chief’s house in Lagos had been kept as exhibit to be used when the trial of suspects in the arms deal begins. The source further alleged that some properties belonging to the former CAS were also held in trust for him by Lara and her children. There were earlier reports that the anti-graft agency had uncovererd N17.5 billion in the accounts of wives of three airforce chiefs.

TY Danjuma-- I Was Third On Dimka’s Death List

Lt. Gen Theophilus Danjuma on Saturday said he was the third person on the list of those marked for assassination during the failed 13 February, 1976 coup d’état that claimed the life of the then Head-of-State, Gen. Murtala Muhammed, and many others.

He said this at the Murtala Muhammed 40th Memorial Lecture held at the Transcorp Hilton Hotel, Abuja where President Muhammadu Buhari and Danjuma, a former Minister of Defence, were among several dignitaries who applauded the virtues and leadership qualities of the late Gen. Muhammed.

President Buhari described the late military ruler as a man with extra-ordinary passion who was in a hurry to make Nigeria better.

He noted that although his late boss had a not-too-easy relationship with some of his colleagues in the Army, his loyalty and dedication to his fatherland was never in doubt.

The President said, “His life, short though it proved to be, was marked by an extraordinary passion, energy and determination to do better, and to make Nigeria better. These are values that young and old alike should all remember – and celebrate.”

While extolling the leadership qualities of the late Head-of State, Buhari noted that by the time Murtala was given Command during the Civil War, the Federal side was on the defensive.

According to him, the rebels had overrun the then Mid-West, and reached as far as Ore, just 100 miles from Lagos.

He said, “By dint of sheer bravery, improvisation and resourcefulness, he mustered a rag-tag group of soldiers, integrated them into an entirely new division, knocked them into fighting shape, recovered Mid-West and ventured across the Niger. Alas, there were terrible casualties on both sides.

“But Murtala’s motto was to get the job done as quickly as possible; sacrifice and loss were part of the risks of war.

“Relations between Murtala and some other senior officers were not always easy. But no one could doubt his inspirational qualities or call into question his love and dedication in the service of Nigeria.”

Buhari further explained that Murtala Muhammed’s death robbed the nation of a leader who was determined to deal with the menace of corruption and indiscipline with an uncommon zeal.

Recalling the events of February 13, 1976, Buhari said he was at his duty post as Military Governor of the defunct North Eastern State when he received a call from General TY Danjuma.

According to him, the following conversation ensued:

“Gen. Danjuma called me and said: ‘Mohammed, where are you?

“I said, in the office sir.

“He said, ‘do you know what is happening?’

“I said ‘where?’ He said in Lagos. He said the Head of State had left his house and was driving his car to the office then around the secretariat, there was shooting.

“I said they must have murdered him. And he said, ‘do something.”’

The President went on to explain how he rallied troops in Maiduguri and Yola to avoid a breakdown of law and order adding that since it was a Friday, he had to go to the Mosque, a decision he said, helped to douse the tension that had built up over happenings in Lagos.

Buhari said within the six months of Gen. Muhammed’s rule, he was able to articulate a clear vision of the legacies he was bequeathing to Nigeria.

He noted that the late general was instrumental to the creation of additional states and laying the foundation for moving the Federal Capital from Lagos to Abuja.

President Buhari enjoined all present to see the occasion as one of celebration and not of mourning because the late icon lived a life worthy of emulation.

Earlier, General TY Danjuma who served under the late Head-of-State said, he was alive only by the grace of God because Lt. Col. Buka Suka Dimka and his gang of conspirators had condemned him to death.

He said, “February 13, 1976 was a Friday. In English mythology -I don’t know how it started, but the combination of Friday and the number 13, represent bad luck.

“When I remember that day; it leaves me with varied emotions because I too had been condemned to die by Dimka and his associates.

“In fact, on the list that he brought to General Iliya Bissalla, our then Commissioner of Defence, to seek his approval, I was number three on the death list.

“Bissalla promoted me to number two. That I am still alive today is by the grace of God.”

He enjoined the Murtala Mohammed Foundation to ensure a proper documentation of its activities for posterity. He promised to finance a documentary of the foundation’s activities on television.

Danjuma stressed the importance of accurate record of events to avoid distortions by those who know nothing about what happened.

In his key note address, General David Richards, former Chief of the Defence Staff, United Kingdom, said Nigeria deserved more accolades for its human and material sacrifice in resolving the conflict in Sierra-Leone than it had gotten.

Richards who spoke on “Regional Security and State Building: Portents and Prospects”, noted that the tendency to recommend the same template for tackling crisis in each state had proved a sad lesson re-lent across continents over the years.

He also noted that contemporary insurgency required a new strategy to tackle because the force of arms alone could not resolve issues therein.

The retired Army General noted that the growth of social media, rivalries among states and on-line real time news adds to the complications experienced in trying to manage conflict.

Richards said, “The loss of the control of the agenda is the greatest threat to the World Order” adding that, states must now do more to gain and retain public confidence through the provision of quality leadership.

An adviser to the Secretary General of the United Nations on West African Affairs, Mohammed Ibn Chambers, recalled that he was a university student studying in Ghana when Gen. Murtala Muhammed was assassinated.

He stated that students all over Africa protested because they knew the contributions Nigeria under the late General’s leadership was making towards liberating the rest of Africa.

The Nigerian Air Force Denies Locating Missing Chibok Girls

The Nigerian Air Force has denied reports that it’s operatives had located the missing girls of Government Girls Secondary School, Chibok.

The Director, Public Relations and Information of the NAF, Group. Capt. Ayodele Famuyiwa, said in an electronic mail on Saturday that the claim misrepresented an interview he granted Channels Television on February 12, 2016.

According to him, what was said was that the NAF had the capacity to identify possible areas where the girls might be held.

Famuyiwa said that while the NAF had not identified the specific location of the missing secondary school girls who were abducted in April 20, 2014, the service had been working hard with surveillance aircraft covering a wide area in the search for the girls.

He said that the NAF would continue to contribute to the mission to degrade the capacity of the insurgents and to work towards finding the girls and other Nigerians held captive by the insurgents.

“The attention of the Nigerian Air Force has been drawn to a statement to the effect that the NAF has located the position of the Chibok girls. Please, let it be known that this statement is a misrepresentation of the interview that the NAF’s Director of Public Relations granted the Channels Television that was aired on Friday 12 February 2016.

“The NAF is hereby making it categorically clear that in the said interview the director made mention of the NAF’s ability to identify possible location that the girls might be in.

“Hence, the NAF wishes to categorically state that it has at no time identified the specific location of the Chibok girls. However, it is working round the clock with surveillance aircraft covering the over 157,000 km2 area of the North East in order to identify the position of not only the Chibok girls but other Nigerians that might have been held captives.

“Towards the realization of this goal, the NAF has from January 2016 till date using aircraft, ISR platforms such as ATR-42, B-350 and CH-3 UAV, flown surveillance missions totaling over 346 hours consuming about 85,887 litres of Jet A-1 and 3,830 litres of Mogas costing N15,337,862:50 and $19,150:00 respectively.

“Therefore, whilst the specific position of the Chibok girls is not yet ascertained by the NAF, we have not folded our arms on the surveillance flights and will continue to use these flights to degrade the capacity of the terrorists and as soon as possible locate the position of the Chibok girls and other Nigerians that are under captivity.” The statement read.

Nigerian Commander and his Cameroonian counterparts share bottles of water after successful clearance operation against Boko Haram

The Nigerian Army troops in the various sectors of the fight against terrorism and insurgency in the north east on Friday, February 12, made tremendous progress in the fight against Boko Haram.
According to a statement released yesterday by the Acting Director Army Public Relations, Colonel Sani Kukasheka Usman:

"A patrol team from 5 Brigade, traversing Dogon Gida and New Marte stepped on an undetected Improvised Explosive Device (IED) buried by suspected Boko Haram terrorists. Unfortunately, 4 soldiers sustained various degrees of injuries and their vehicle was badly damaged. The wounded soldiers have since been evacuated by Nigeria Air Force. Nevertheless, the team has been reinforced and have continued their patrols until they fish out the perpetrators and neutralize them.

Similarly, to further buttress the collective resolve in the fight against Boko Haram terrorists between Nigeria and our neighbouring countries, troops of 25 and 26 Task Force Brigades in conjunction with Cameroonian forces carried out clearance operation against the Boko Haram terrorists around Ngoshe village.
While the Cameroonian troops carried out the clearance, their Nigerian counterparts provided blocking forces at strategic points where they decisively dealt with fleeing terrorists that tried to escape. Consequently, troops of 121 Task Force Battalion also advanced to Mararraba, Angwan Fada, Dale, Wizha, Bokko Timit, Bokko Nasanu, Bokko Hide, up to Ngoshe village where they linked up with the Cameroonians.

During the operations all Boko Haram terrorists enclaves within the area were cleared. In the process, the troops killed 10 Boko Haram terrorists and also rescued 45 persons which included 17 women and 28 children. The troops also discovered that the terrorists cratered the road linking Pulka, Mararraba and Ngoshe and safely detonated 5 IEDs buried by the terrorists. In addition, they also destroyed an IED manufacturing workshop in the village. They also cleared Sino village.

The Cameroonian forces have also knocked out Boko Haram terrorists gun trucks, raided and cleared several IED making factories along the border towns.

Russia--- Accuses Bill Gates Of Engineering The Zika Virus As A ‘Bioweapon

The Zika virus is a bioweapon that is using GMO (genetically modified) mosquitoes to spread ‘future diseases’ according to a Kremlin report. And the finger of blame is being pointed squarely at Bill Gates accordiing to Disclose.tv. It is understood the bioweapon was developed by Bill Gates to achieve his self-confessed Illuminati goal of depopulating the world. According to a leaked highly confidential Foreign Intelligence Service (SVR) report that has been read by sources in the Kremlin, it has been revealed that the Zika virus was ‘cooked up as a bioweapon’ by ‘world governments and non-government organizations.’ It is understood the chief non-government organization behind the Zika virus is Bill Gates’ own Bill & Melinda Gates Foundation.

President Putin is said to be ‘angered.’ There have been meetings in the past 24 hours regarding banning Gates from the Russian Federation, as well as plans to protect humanity from the ‘world government created bioweapon.’ ‘GMOs are humanity’s mortal enemy and these agents won’t be happy until most of us are dead.’ ‘Western powers are in their final death throes, thrashing about and clutching at straws, using the last weapons in their arsenal of dirty tricks against humanity. We must not allow these GMO serial killers to poison our children.’

In 2010, the Bill & Melinda Gates Foundation funded Australian research scientists to release GMO mosquitoes infected with a bacterium. That same year, Bill Gates confessed he wanted to depopulate the world – a key Illuminati goal. “The world today has 6.8 billion people; that’s headed up to about 9 billion,” he said during the invitation-only 2010 TED Conference. “Now if we do a really great job on new vaccines, health care, reproductive health services, we lower that by perhaps 10 or 15 percent.” Now those bacterium-infected GMO mosquitoes created by Bill Gates in 2010 are wreaking havoc in the Americas – with the whole globe at risk, according to the World Health Organization (WHO).

The WHO is now convening an Emergency Committee under International Health Regulations concerning the ‘explosive’ spread of the Zika virus throughout the Americas. The virus reportedly has the potential to reach pandemic proportions — possibly around the globe. But understanding why this outbreak happened is vital to stopping it. The finger of blame is pointing squarely at the richest man in the world. What are they going to do about it?

Fayose-- Nigerians Deserve Truth About Buhari’s Sudden Vacation

Governor Ayodele Fayose of Ekiti State, on Sunday, said that the statement issued by the Presidency on President Muhammadu Buhari’s sudden vacation was vague, saying, “Nigerians deserve to know the truth about their President because the President is an open book that every Nigerians should be free to read.”

The governor, who said he was aware of the high-wire plot to use the Supreme Court to upturn his electoral victory, insisted that nothing will stop him from speaking the truth concerning issues in the country.

He said it was suspicious that a president, who told Nigerians that he was embarking on official visit to France and Britain, last Tuesday, would suddenly commence a five-day vacation while still in the United Kingdom.

In a statement by his Special Assistant on Public Communications and New Media, Lere Olayinka, the governor, who prayed for safe return of the President, said “Nigerians deserve to know where exactly their president is spending his vacation.”

He however commended the President for handing over to the Vice President as stipulated by the Constitution of the country.

He said; “We were told last Tuesday, that Mr President was travelling to France and from there to London to attend the Syria Donor Conference, and that he would return to Nigeria this weekend.

“All of a sudden, we were told that the President was embarking on a five-day vacation. Where and why? We were not told.

“Curiously, it was at this same period, last year that President Buhari, who was at that time the All Progressives Congress (APC) presidential candidate, disappeared from public, with lies told about him granting interviews in London.

“It is therefore important that in future, the presidency should be more explicit in communicating with Nigerians on issues regarding the President because a nation’s president is an open book that can be read by anyone.”

Ahmed Raji---‘Dasuki was forcefully retired for telling Abacha to install MKO as president’

Former National Security Adviser, Colonel Sambo Dasuki is a lawfully retired officer of the Nigerian Army and not a fugitive, his lawyer confirmed.

Responding to allegations that the former NSA, who is currently being held by the Department of State Services, is a fugitive who breached army service rule- the accused’s lawyer, Ahmed Raji (SAN) has declared that the claim is a fallacy and a concocted lie thought-up by the prosecution to confuse the court, following the prosecution’s inability to answer to a well-grounded objection raised by Raji while the court was in session.

While trying to justify why the DSS still have Dasuki in custody despite the bail granted him by the court, Rotimi Jacob, counsel to the Economic and Financial Crimes Commission in the alleged money laundering case against the accused, had told the court that Dasuki was still being detained because of his past in the military.

Jacob, on Thursday, February 4, told Justice Husseini Baba Yusuf that Dasuki went on exile for seven years, which he registers is a breach of the army service rules.

However, according to Raji, his client legally left the Army in 1994 and his exit in the military was officially gazetted by the Federal government through the former Head of State, General Abdulsalami Abubakar in 1999.

The lawyer stated that “the allegation of fugitive against Dasuki cannot hold water on stand in the face of the law in view of the official gazette of the Federal Government that confirmed his retirement from the military.

“It is curious that the prosecution counsel who initially claimed ignorance of the reason behind the denial of bail is now coming up with these excuses… I am tempted to believe that my learned friend Mr. Rotimi Jacob SAN must be genuinely mixing-up facts or mistake of identity.”

Raji further added: “The allegation is baseless, unwarranted and malicious because his exit was in the gazette of the Federal government. We accordingly urge those holding Dasuki in the custody in flagrant disobedience to the court order that granted him bail to have a rethink and respect the rule of law.”

In the same vein, PRNigeria reports that Dasuki was held in contempt and hounded by the former Head of State of Nigeria, late General Sani Abacha when he declared that the late MKO Abiola is the legitimate winner of the annulled June 12, 1993 Presidential election and should be installed as president.

Dasuki and other officers were prematurely retired from service in 1994 for making this suggestion to the deceased Abacha.

“The resultant persecution forced Dasuki into an exile where he worked with other patriotic Nigerians to clamour for the return of democracy in Nigeria same as some top politicians in the administration of President Buhari.

Dasuki and others were declared wanted by Abacha’s police because of their fight for the return of democracy in the nation.”

Meanwhile, in an official Gazette No 33 Volume 86, Dasuki was stated to have been granted clemency and pardon along with others on March 4, 1999 by General Abdulsalam Abubakar, the then Head of State and Commander in Chief of the Armed Forces, for their innocence and meritorious service to their fatherland.

The young inventor started a fundraising campaign, hopes to get N2,000,000 (or $10,000) asap

– Emeka promises that his new invention, an “ultra modern bio digester” is coming soon

Nsukka-born Emeka Nelson claims to have invented a generator that runs on water, a machine for recycling non-biodegradable wastes. His third invention, a bio digester, is under development.

A graduate of the National Metallurgical Training Institute has started a fundraising campaign on social media trough his partner, Karo Kanye Akamune.

“I can imagine a world where human feaces, urine etc are turned into cooking gas and best of fertilizers for our farmers.

“I can imagine a society where this machine replaces all our soak away and pit latrine toilet systems. Creative minds tech team is working on it now,” the scientist/engineer wrote in his post dated February 6, announcing the new invention.

Buhari-- $1m On Foreign Trips: Fayose Can Say ‘ Whatever He Likes’

President Muhammadu Buhari has said that contrary to the claims by critics of his incessant foreign trips, none of the trips he had made so far can be said to be frivolous.

He said there were always political and economic justifications for his trip.

Buhari said this on Friday in London while answering questions from some Nigerian journalists shortly before he commenced a six-day vacation that would end on Wednesday.

Our correspondent obtained the transcript of the interview on Saturday.

It will be recalled that Ekiti State Governor, Mr. Ayodele Fayose, had asked Buhari to stay at home and govern the country instead of junketing from one country to the other.

Fayose had said that the President’s incessant foreign trips were already bleeding the economy with about $1m being spent per trip.

But Buhari said he did not know how Fayose arrived at the figure he gave.

He said, “Every one of my trips can be politically or economically assessed. I recall that the first trip I had was to go to Chad and Niger. The trip was mainly because of Nigeria’s security.

“We campaigned based on three issues -security, economy (employment) and corruption. And then the G-7 invited me to Germany. After that, I went to Cameroon. I then went to the United Nations General Assembly.

“I have not seen any frivolous journey that I undertook. I understand that the governor of Ekiti State said that every trip I make costs Nigeria at least $1m. I do not know how he worked that out but every trip that I have made, there must be economic and political reasons that justified them.

“Those who do not see it the way the government sees it have the right not to agree and say whatever they like. But we will try and give them the appropriate reply.”

Buhari also promised to take his administration’s ongoing anti-corruption war to all sectors of the economy.

“We have to go the whole hog into other sectors because unlike what some people believe that the fight against corruption is selective, although they have failed to define the selectivity in their own understanding, there is no way we can get a public officer on record that has misappropriated public fund and we will leave him alone.

“It is one of the undertakings that the Federal Government made and we are going to see it through,” he said.

The President identified the need for firm evidences against corrupt persons as one of the main challenges facing the war.

“The challenge mainly is to affirm evidence. If you just hear our story that somebody built 12 houses in Abuja, houses do not move. Do they?

“It is for us to do verification. We need to verify and quantify before the man is invited to justify how he acquired those properties while he is a public officer,” Buhari explained.

He promised to make a representation to the Chief Justice of Nigeria, Justice Mahmud Muhammed, on the various complaints being made against judges in the country.

He recalled that a lot of allegations had been levelled against some of the judges who served on election tribunals.

He, however, declined to comment on the recent Supreme Court verdict that validated the elections of Governor Nyesom Wike (Rivers) and Governor Udo Emmanuel (Akwa Ibom) until he holds a discussion with the Ministry of Justice.

Buhari insisted that despite the killings being witnessed in public places, his government is winning the war against terrorism.

He said, “We are winning the war. I have said that Boko Haram used to effectively control 14 local governments, they hoisted their flag and declared a caliphate of some sort.

“But now, Boko Haram is not holding any local government. They have been dispersed. They have reverted to technology.

“They use Improvised Explosive Devices. They use cooking gas, some wires and metals, put them together and get girls from the age of 15 downwards and explode them in churches, mosques, markets or motor parks and kill people en masse.”

suspected Car Snatcher-- I Robbed People To Build A House (photo)

NEMESIS has caught up with two syndicates which specialized in the hijacking of heavy duty trucks along Benin / Ore Expressway and the snatching/stealing of posh vehicles in Ondo State. Different vehicles and trucks were recovered from the syndicates by detectives from the state Police Command. Sunday Vanguard gathered that two suspects, Dele Olayemi and Ayo Akinde, were leaders of one of the syndicates which specialized in stealing cars parked by owners.

Olayemi….Claimed to have snatched 11 different vehicles
The other syndicate, which specialized in the hijacking of heavy duty trucks and petrol tankers, was said to have been coordinated by four suspects, namely: Sunday Olufemi, Idowu Omowole, Ebenezer Onos and Akeem Mayama,

All the suspects who have allegedly made confessional statements are in police detention.

Over 11 different vehicles were recovered from the first syndicate while 14 were taken from the other group.

Speaking with Sunday Vanguard, the leader of the syndicate that allegedly snatched posh cars, Moses Olayemi, said he went into the business to make money so as to build a house.

“ My father married three wives and he refused to send us to school. I only went to primary school.

“ I have been able to buy a land and what I am looking for is money to start the building after which I want to marry. “ Some of my friends introduced me into this business of snatching and stealing of cars,”he stated. When asked how many vehicles he had stolen, he said he could only remember the number of those he stole in the last 11 months.

“ I can only remember that over 11 different cars were snatched and stolen where the owners parked them by my gang in the last 11months. “The receiver of the stolen vehicles, one Omo Ode, used to buy the vehicles for between N80,000 and N140,000.” Dele explained that the dealer usually changed the number plate and other parts of the vehicle before selling to unsuspected buyers.

“ We sold any jeep or posh car that we stole for N140, 000 while we sold smaller cars, whether new or old, for N80,000. “When we stole a car, we will remove its number and register it with a new one.

“We would change some parts of the vehicle so that the owner would not be able to identify it because most of the cars are being used in Akure, the state capital” The suspect, however, wondered why the dealer, popularly called ‘Oluomo’, who usually bought the stolen vehicles from them, was not arrested alongside them.

On how he stole vehicles, he said, “ I will enter the market, buy ignition key. I will use the key to test the car. If it starts, I will take the vehicle away; if not, I will leave it and run away.” Sunday Vanguard gathered that Dele ran out of luck when, at gun point, in front of UBA, in Akure, he snatched a Nissan Almera car. Detectives swung into action after the matter was reported to the police and the car was later recovered at Oba Akoko area of the state with many of its parts replaced. Ondo State Police Commissioner Mike Ogbodu said the suspects would soon be charged to court.

Woman recounts how her cousin was kidnapped, brutally beaten and murdered

Late Ebere Helen Peters's security guard conspired with a gang of kidnappers to have her kidnapped in order to extort money from her husband. Unfortunately, the plan went awry...Below is what her cousin Oby Ndukwe wrote on Facebook:

"It was on a faithful day, January 19th when she was lured into rendering assistance to her security guard who claimed to be preparing for his wedding. He asked her to help him plan his wedding, claiming to have N200k.
While she had accepted to help, the guard asked that she followed him to the venue for the reception in order to sign a guarantor's form, in the event that in the course of the reception, something goes wrong with the facilities. And off they went to the nonexistent reception venue. Unknown to her, it was a trap. She was to be used as a people bait to force her husband to part with some money. She had been kidnapped!

The wicked guard and his five man gang tortured her as she fought hard to resist being tied up. They so beat her that when she became weak, they got her tied up and called in an elderly untrained nurse to inject with some kind of anaesthesia. From the forced sleep, to a forced death. Death so cheap!

The assailants eventually took her to the hospital, hoping that she was not dead. But, truly, she was dead. Then the hospital management arrested the quack nurse and the guard. The rest is story.

She rose from abject poverty to wealth From the slums of Lagos to the high brow Gowon Estate in Lagos. Death so cruel. A husband, a mother, four children and siblings awaiting her return. But she died while fasting. She died while showing kindness.

Oh Death! why so cruel? Eby, Good night until we meet to part no more. May you find rest in the bosom of the Lord"

Atiku Accused Of Trying To Install Loyalist As Deputy Governor in Kogi

Former Vice President Atiku Abubakar may be pushing for loyalist to take the position of the Deputy Governor of Kogi State, a Chieftain of the All Progressives Congress (APC) in the state, Mallam Abdullahi Kabiru has alleged.

Mr. Kabiru in a statement he issued to the media yesterday, accused the ex-VP of “causing disarray in the leadership hierarchy of Kogi State All Progressives Congress in his bid to impose his loyalist, and former member of Kogi State House of Assembly, Simeon Achuba as replacement for Hon. Abiodun Faleke who turned down the offer of Deputy Governor after demise of Audu Abubakar his Principal and Governorship Candidate of APC who was already coasting to victory in the race for Kogi State Governorship seat before he suddenly died last November”.

According to him, “In the past days, Atiku, according to our dependable sources has been pulling the strings with a view to ensuring that Simeon Achuba becomes Governor Yahaya Bello’s Deputy, and that this has led to massive rancour in the leadership of APC in Kogi State”.

The APC Chieftain alleged that ‘’We are conscious of Atiku Abubakar’s moves to impose on us Simeon Achuba as our next Deputy Governor, but I can assure you that we are not going to cave into that. Again we’re also not unmindful that lots of resources have been deployed in the past few days, including millions of naira to bribe people into buying the idea of Achuba becoming the next Deputy Governor of Kogi State, but let me say with all emphasis at my disposal that all these clandestine moves shall end up in vain’’.

It will be recalled that the leadership of the State Legislature has been embroiled in a tussle, which has led to the impeachment of Momoh Jimoh and Ali Akuh as Speaker and Deputy Speaker respectively.

Also in the race for Deputy Governor of Kogi State, are Hon. Tim Diche, a former Governorship aspirant, Hon. Ikani Okolo, a member representing Dekina/Bassa Federal constituency in the House of Representatives and Ambassador Aisha Audu Emeje, widow of late Audu Abubakar, who is believed to be favoured for the position of Deputy Governor in Kogi State.

Orange County-- Ex-PTA principal awarded $5.7M after couple planted drugs in her car

A Orange County couple was ordered to pay $5.7 million for planting drugs in the car of a former PTA president in a failed bid to have her arrested. A jury on Friday made the award to Kelli Peters. The Superior Court panel deliberated less than an hour before finding that Kent Easter of Irvine and his ex-wife, Jill Easter, acted with malice, oppression or fraud, the Orange County Register reported.

Kent Easter declared bankruptcy before the civil trial but such protection doesn’t extend to the lawsuit damages, said Rob Marcereau, Peters’ attorney.

Authorities said the Easters had an ongoing feud with Peters that started with a comment she made about their 7-year-old son when they planted prescription painkillers, marijuana and a pot pipe in Peters’ car in 2011. They then called police, who briefly detained her at Plaza Vista School in Irvine, where she volunteered.
Peters testified that she was humiliated as a police officer searched the car as her own daughter watched.
“I was crying and begging for him to not put the drugs on the car, because people would see it,” Peters said. “Everybody was looking at me.”
She was questioned for about two hours.
Kent Easter, representing himself during the case, argued that Peters was exaggerating her distress in order to reap a financial reward.
“The fact that something really bad was done to a person does not give them a winning Powerball number,” he told the jury.
Easter declined comment after the verdict and Jill Easter, who also represented herself, was not present in court for the verdict, the Register said.
Peters said the Easters have never shown remorse for their action.
“This was really not about money, this was about standing up to people that pick on other people and telling them it’s not OK to do this,” she said, wiping away tears. “I wouldn’t have gone this far had they said they were sorry,” Peters said.
In 2014, Kent Easter was convicted of felony false imprisonment. He spent 87 days in jail. Jill Easter pleaded guilty to the same charge and spent about 60 days behind bars.

No extradition order ‘NDLEA is a lawless organisation in the eyes of right thinking people’ – Kashamu

Senator representing Ogun East Senatorial district, Buruji Kashamu has denied the existence of any extradition order issued against him.

This denial is coming in the heels of an alleged statement by the Public Relation Officer of the National Drug Law Enforcement Agency (NDLEA), Mitchell Ofoyeju, claiming that there is a subsisting extradition order against him.

In a statement by his Media Aide, Austin Oniyokor, he said the NDLEA statement was misleading, adding that ‘nothing could be farther from the facts and truth.

Kashamu maintained that the operative was playing the script allegedly concocted by its former chairman, Ahmed Giade, who is now the Special Assistant to the Minister of Justice and Attorney-General of the Federation (AGF) on Narcotics.

“Let it be reiterated that Senator Kashamu is not worried about extradition proceedings being brought against him in accordance with Nigerian laws. He knows that it can never succeed in view of the decisions of the English courts that have exonerated him and has confirmed by several judgments of competent Nigerian courts.”

“Mr. Ofoyeju and his co-travellers should acquaint themselves with the basic facts and details of a case before making pronouncements that could further cast the NDLEA as a lawless organisation in the eyes of right thinking members of the society, and among the comity of nations.”

“Two British courts heard extradition proceedings against Senator Kashamu at the instance of the US authorities and found that it was a case of ‘mistaken identity,’ and released him.”

Barely a week after the boat mishap in Badore which claimed the lives of seven people, another boat has capsized in the Badagry area with two feared dead.
According to reports, the fibre boat which had 10 passengers crashed into a log of wood after it took off on Saturday from Ebute Iworo Jetty, en route Badagry.
Out of the ten passengers on board, only four of them were reported to have used life jackets.

Confirming the incident, the National Emergency Management Agency (NEMA), NEMA South-west Spokesperson, Mr. Ibrahim Farinloye said:
“Unlike the previous incident which was caused by sand dredgers, this incident happened because the boat hit a log and capsized, upturning its passengers into the water.“The boat is called a fibre boat because it has engine. It happened in Badagry. It so happened that the open canoe hit a log while sailing, lost balance, and capsized with 10 passengers.
“Emergency responders like the Marine police, LASWA, NIWA and local divers have rescued eight people alive while the search for a woman and the driver of the canoe continues. The correct figure of those rescued alive is eight. Also, out of the eight, only four wore life jackets while others did not.

Sambo Dasuki To Face Fresh Charges Over 1994 Millitary Charge

Nigeria's former national security advisor remains in custody as he is under investigation for alleged offences committed decades ago when he was an army officer, a state prosecutor said Thursday.

Sambo Dasuki is already facing three trials with a slew of charges in connection with looting billions of dollars that were supposed to go towards fighting Boko Haram Islamists.

He is one of just 55 people the Nigerian government claims stole more than $6 billion between 2006 and 2013, leaving Africa's biggest economy reeling in the wake of the global oil price plunge.

But despite being granted bail in December, Dasuki has been kept in custody by Nigeria's intelligence agency, the Department of State Services (DSS), without access to his legal counsel.

Prosecutor Rotimi Jacobs told an Abuja court that Dasuki was rearrested because the government is investigating an "alleged breach of service law" when he was serving as a colonel in the army before his retirement in 1994.

Defence lawyer Joseph Daudu said Dasuki -- a powerful member of former president Goodluck Jonathan's administration -- is being denied the right to a fair trial and that all three cases against him should be dismissed.

"There's really no way he can get a fair trial in the circumstances," Daudu said to AFP, vowing if necessary to take the matter to the Supreme Court.

Dasuki is rumoured to have arrested Muhammadu Buhari at gunpoint when he was overthrown in a 1985 coup after serving nearly two years as head of a military government.

Daudu said that Dasuki will neither "confirm or deny" that rumour, but added there is "no love lost" between his client and Buhari, now Nigeria's elected president.

Political analyst Chris Ngwodo said that far from settling old grievances, the ultimate reason for Dasuki's continued incarceration is that the government is struggling to stitch together its case against him.

"What is the most important thing for them is for him to be in custody, they do not want to make him free," Ngwodo said.

"So they are resorting to somewhat underhanded tactics," Ngwodo said. "What they will keep doing is finding fresh ways of holding him in custody until they can fine tune their case."

Employees Set On Fire House Of Chinese Boss after stealing N450,000

The greed of 30-year-old Frank Chukwuneye and Abdullahi Zakari, 25, was on steroids when they conspired to steal N450,000 from their employer, Tom Wu, a Chinese businessman based in Benin city, capital of Edo State.

The evil duo of Chukwuneye and Zakari were employed three months ago by Wu, to serve respectively as his interpreter and security guard.

While Chukwuneye was placed on a monthly salary of N70,000, the Chinese paid Zakari N30,000 per month. He did so regularly.

But demon of greed took hold of their minds and the seed of conspiracy was sown. During the yuletide period, on December 29, Wu withdrew N450,000 from the bank. Upon reaching home, he asked Chukwuneye to put it on the top of the drawer in his bedroom. Later he went out with Chukwuneye.

Meanwhile, as Sunday Sun correspondent gathered from the Edo State Commissioner of Police, Mr. Chris Ezike, Chukwuneye had conspired with Zakari to steal the money. He gave Zakari the spare key to the bedroom of Wu and told him where to find the money. To ensure his cooperation, he also promised to give him N100,000, and this sealed the conspiracy.

Narrating what happened next, Zakari told Sunday Sun in an interview at the headquarters of the State Criminal Investigation Department, where he and Chuwkuneye are being held in custody, as investigation progresses: “On December 30, 2015 when our Chinese master went out, I went to his bedroom, opened it with the key Frank gave me. I saw the N450,000 where they kept the money on the drawer. I took the N450,000, put in the hollow of a loudspeaker and then set the house on fire.”

Upon learning that his house was on fire, Wu rushed back home. Suspecting foul play, he went to Ugbor Police Station, accompanied by Chukwuneye, to make a formal report to the police.

The case was then transferred to the State CID Benin City, which commenced investigation immediately.

Ezike told Sunday Sun that the Assistant Commissioner of Police, Mr. Chukwudi Ariekpare, SCID, told the officer-in-charge of general investigation, Supol Stella Ebikefe (SP), to dispatch a team of detectives. In course of investigation, the trail led to the two employees. When properly questioned, they spilled the beans, confessed to the crime, and gave graphic details of the roles played by each of them.

Chukwuneye in his confessional statement admitted that he was the mastermind of the evil act.

Recounting his role to Sunday Sun reporter, he said: “Three months ago, I was employed by the Chinese as an interpreter and he paid me N70,000 monthly. I masterminded the whole ugly incident; I gave the security man, Abdullahi, a spare key to the bedroom of our master and told him to set the house ablaze after taking the money.

“It was people in the neighbourhood who alerted me that the house was burning, but I pretended as if I didn’t know what was happening. I followed my master to Ugbor Police Station to make a report.”

Expectedly, the victim, Wu, felt deeply betrayed by the two men he employed. He said: “I was shocked to learn that the two Nigerians I employed and made them comfortable and also paid them regularly committed the crime. I employed Frank as my interpreter and gave him everything he wanted, yet he betrayed me. He was the only person who knew that I brought N450,000 from the bank and put it in my bedroom. I want justice to be done and the police to recover my money from them.”

Ezike assured that the suspects would be charged to court soon.

Fresh crisis hits Assemblies of God church,South South zone breaks away

The crisis in the Assemblies of God Nigeria, has taken a new dimension, as the South-South zone of the church has pulled out from the body.

The South South zone cited instances of marginalisation, gross injustice in ministers’ remuneration, unhealthy rivalry among ministers, inefficiency and escalating administrative and financial malfeasance- as justification for its departure from the church.

Zonal chairman, Central Working Committee, South-South General Council, Assemblies of God, Evang. Nsikak Akpan, made the disclosure on Saturday at a press conference, attended by other executive members of the church including executive members of the Pentecostal Fellowship of Nigeria in Akwa Ibom.

Akpan stated that his zone arrived at the decision to break away from the general council administration in order to achieve some level of self-governance.

He said the general council had grown too big and had become too expensive to run.

Akpan said this has utimately resulted in a supremacy battle between the General Superintendent of Assemblies of God, Rev. Prof Paul Emeka and the executive committee members under Rev. Dr. Chidi Okoroafor.

“The South-South zone of the Assemblies of God has called for the decentralisation of the general council administration to end marginalisation and gross injustice in ministers’ remuneration; unhealthy rivalry among ministers; inefficiency and escalating administrative and financial malfeasance.

“The only panacea to the growing crisis enveloping the Assemblies of God in Nigeria, leading to the birth of two general councils, which often result in fresh crises in the church across the nation, is to decentralise and reorganise the General Council into six or 12 autonomous general councils with little economic and administrative power at the centre.”
